Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of the Dugout Duty website at https://dugoutduty.com and the Dugout Duty volunteer scheduling service (together, the "Service"), operated by Dugout Duty ("we," "us," "our"). By using the Service, starting a trial, or signing up as a volunteer, you agree to these Terms. If you use the Service for a League, you agree on behalf of that League, and "you" includes the League.

2. Description of Dugout Duty

Dugout Duty is scheduling and administrative software for youth baseball and softball organizations ("Leagues"). It helps Leagues manage umpire volunteer openings for games, concession stand volunteer shifts, public volunteer signups, team-to-credit tracking, volunteer confirmations and reminders, and administrative scheduling.

Dugout Duty is not a league registration system, a payment system for league participants, a roster management system, a team communication platform, a standings or scoring system, or league accounting software.

Dugout Duty is an independent product and is not affiliated with or endorsed by Little League Baseball, Inc. or any other youth sports governing organization unless we explicitly state otherwise.

3. Eligibility and Authority to Use the Service

You must be at least 18 years old to create an administrator account or sign up as a volunteer. If you set up or manage the Service for a League, you represent that you are authorized to act for that League and to bind it to these Terms.

4. League Administrator Accounts

League administrators sign in with an account. You are responsible for providing accurate account information, keeping your credentials confidential and not sharing accounts, all activity under your account, and promptly notifying us at james@dugoutduty.com of any unauthorized use. Each League controls which of its people have administrator access, and administrators can access only their own League's data.

5. League Responsibilities

Dugout Duty provides scheduling and administrative software only. Each League is solely responsible for:

• Its own volunteer requirements and policies;
• Determining who is eligible to volunteer;
• Background checks, screening, training, and certification requirements;
• Compliance with applicable youth sports rules, governing-body requirements, and laws, including child-safety laws;
• Supervision of volunteers and activities; and
• All staffing decisions, including who actually works a game or shift.

Dugout Duty does not perform, certify, or guarantee background checks or volunteer screening, and does not approve, certify, or guarantee that any volunteer is eligible, qualified, suitable, or safe to work with minors. A signup in Dugout Duty records only that a person offered to volunteer. It is not an approval.

Leagues are also responsible for the accuracy of the information they enter, for having the rights and permissions needed to enter it, for providing any notices their volunteers require, and for how their administrators use volunteer information.

6. Volunteer Signups

Volunteers may sign up through a League's public signup pages without creating an account. By signing up, you agree to provide accurate information and to sign up only yourself or someone who has authorized you. Your signup is shared with the League you signed up with. Volunteer duties, schedule changes, and eligibility are between you and the League, and Dugout Duty is not responsible for a League's decisions or for changed or canceled games or shifts.

Your confirmation and management links are private. Anyone who has the link may be able to access your signup. You are responsible for keeping those links private.

7. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, harmful, or fraudulent;
• Submit false signups, spam, or other people's information without permission;
• Attempt to access another League's data or any part of the Service you are not authorized to use;
• Probe, scan, or test the Service's security, or circumvent rate limits or access controls;
• Interfere with or disrupt the Service, or upload malicious code;
• Scrape, copy, resell, or reverse engineer the Service, except as permitted by law; or
• Use the Service to harass anyone or send unsolicited messages.

We may suspend access that violates these rules or threatens the Service or other users.

8. Subscription Pricing

The Service costs $300 per year per League, unless we agree otherwise in writing. Each subscription term is 12 months beginning on the date the paid subscription starts. Prices do not include applicable taxes, which you are responsible for. We may change prices for future terms with advance notice.

9. 7-Day Free Trial

New Leagues may request a 7-day free trial. No credit card is required for the trial. After an unpaid trial expires, public signup functionality may be disabled and administrative functionality may be restricted. Trial data may be retained for 30 days so the organization can subscribe without rebuilding its setup, after which it becomes eligible for deletion. We may extend trials at our discretion. Generally, one free trial is available per League or organization unless we approve otherwise.

10. White-Glove Season Setup

White-Glove Season Setup is an optional service priced at $300 per season. It includes assistance with initial season configuration using information supplied by the League, including applicable divisions, teams, fields, credit teams, schedule and import assistance, concession shifts, and initial volunteer setup. It includes the initial setup and up to two reasonable rounds of corrections.

Our target is to complete setup within five business days after we receive all information reasonably required to perform it. This is a target, not a guarantee.

White-Glove Setup does not include ongoing league administration, volunteer recruiting, background checks or screening, or ongoing schedule management. The League remains responsible for reviewing its setup for accuracy.

11. Billing and Renewal

Annual subscriptions are intended to renew automatically for additional 12-month terms at the then-current subscription price unless canceled. We will provide advance notice before renewal. Payment is due upon renewal.

If a payment fails or is late, we will allow a reasonable grace period before service is suspended. Specific payment methods and billing mechanics will be described when online billing becomes available; until then, we will arrange payment directly with each League, and we will not charge any payment method without the League's authorization.

12. Cancellation

A League may cancel at any time by contacting james@dugoutduty.com. Cancellation takes effect at the end of the current paid subscription period, and the Service remains available through that date. After cancellation or expiration, the League has 30 days to request an export of available League data before that data becomes eligible for deletion.

13. Refunds

Annual subscription payments are generally non-refundable once the paid subscription begins, except where required by law or when Dugout Duty elects to issue a refund.

White-Glove Season Setup is refundable before setup work begins and becomes non-refundable once setup work has begun.

14. Customer and League Data

As between the League and Dugout Duty, the League owns the data it and its volunteers submit to the Service ("League Data"). The League grants Dugout Duty permission to host, process, copy, and display League Data only as needed to provide, secure, support, and improve the Service, and as described in our Privacy Policy. Each League's data is kept separate from other Leagues. We may use aggregated, de-identified information that does not identify any League or person to operate and improve the Service.

Authorized Leagues may request an export of relevant League Data in CSV format by contacting james@dugoutduty.com. League Data retention and deletion are described in our Privacy Policy.

15. Privacy

Our Privacy Policy (https://dugoutduty.com/privacy) explains how we handle personal information and is part of these Terms.

16. Intellectual Property

Dugout Duty and its licensors own the Service, including its software, design, text, graphics, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms during your trial or subscription. If you send us feedback or suggestions, we may use them without obligation to you.

17. Third-Party Services

The Service relies on third-party providers, such as hosting, authentication, email delivery, analytics, and, once billing is available, payment processing. Links to third-party sites are provided for convenience. We are not responsible for third-party services we do not control, and their own terms may apply.

18. Service Availability

We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted, timely, or error-free. Maintenance, outages, and events beyond our control may affect it. Email delivery, including confirmations and reminders, depends on outside systems and recipients' email providers, so we cannot guarantee any message is delivered or received. Leagues should not rely on the Service as their only means of confirming coverage for a game or shift.

19. Changes to the Service

We may add, change, or remove features. If we remove a core feature a paying League relies on, we will make reasonable efforts to provide advance notice.

20. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DUGOUT DUTY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DUGOUT DUTY DOES NOT WARRANT THE IDENTITY, BACKGROUND, ELIGIBILITY, QUALIFICATIONS, CONDUCT, OR SUITABILITY OF ANY VOLUNTEER, AND IS NOT RESPONSIBLE FOR THE CONDUCT OF LEAGUES, ADMINISTRATORS, VOLUNTEERS, OR OTHER USERS.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) DUGOUT DUTY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; AND (B) DUGOUT DUTY'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT THE LEAGUE PAID DUGOUT DUTY IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF NOTHING WAS PAID. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

22. Indemnification

Each League will defend, indemnify, and hold harmless Dugout Duty from claims, losses, and expenses (including reasonable attorneys' fees) arising from the League's League Data; its volunteer eligibility, screening, supervision, and staffing decisions; the conduct of its administrators or volunteers; or its violation of these Terms or applicable law.

23. Termination

We may suspend or terminate access to the Service if you materially violate these Terms, fail to pay amounts owed after any applicable grace period, or use the Service in a way that creates legal or security risk. Where reasonable, we will give notice and an opportunity to cure first. Provisions that by their nature should survive termination (including Sections 5, 13, 14, 16, and 20 through 25) will survive.

24. Changes to These Terms

We may update these Terms. We will post the updated Terms on this page, revise the Effective Date, and give League administrators reasonable notice of material changes. Continued use of the Service after changes take effect means you accept the updated Terms.

25. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any legal action relating to these Terms or the Service will be brought in the state or federal courts located in or serving Hernando County, Florida, and you consent to venue there.

Before filing any legal action, where legally permitted, the party raising a dispute must first send the other written notice describing it, and both parties will attempt in good faith to resolve it informally for at least 30 days. Notices to Dugout Duty should be sent to james@dugoutduty.com.
